Who accused the tempered glass road studs made by Seih-Ying Co., Ltd. in Taiwan with false content?

In August 2009, the click rate to web site of Seih-Ying Co., Ltd. (www.siglite.com.tw) increased dramatically. Except for our buyers from worldwide, the identities and intentions of other visitors were unclear. After notification from net friends about unknown person posting articles to accuse our tempered glass road marking reflectors, we reviewed the content of accusation and found it filled with cheap and false text.

Content of 3W’s (the former 3W Asia Limited and Shanghai Soda Traffic Facility Co., Ltd.) web site with accusation towards the Seih-Ying Co., Ltd. in Taiwan

The content of articles circulating on internet and the content posted on 3W’s web site that abused and accused Seih-Ying Co., Ltd. in Taiwan were quite similar after comparison. When busy blaming the others, 3W seemed to forget that they have more fingers pointing towards themselves.

How did Seih-Ying Co., Ltd. in Taiwan offend 3W?

1. Seih-Ying verified that the compressive strength of 3W's glass road studs could only achieve 3.5 tons:

The oversea client of Seih-Ying imported a batch of sphere glass road studs from Shanghai a while ago and most of the products were broken several months after the installation. In addition to monetary compensation, our client was even prosecuted by the local government with the charge of offenses against public safety. However, the exporter in Shanghai refused to come forward and not even answering the telephone calls. Subsequently, our client sent few glass road studs with the “3W” brand at bottom to us and our laboratory verified that the compressive strength of these road studs only achieved strength of 3.5 tons. The client considered to be fooled by the trading company in Shanghai and is now coordinating with the client’s Ministry of Foreign Affairs for preparation of law suit. Since then, 3W started to post articles on their web site to abuse Seih-Ying with unspeakable language of filth.

2. Seih-Ying revoked the patent for Shanghai Soda:

Qie-Yi Chen, the responsible person of Shanghai Soda Traffic Facility Co., Ltd. used the tempered glass road studs produced by Seih-Ying in large bulk since 1991 for applying the Chinese Patent in 2004 and received approval. After that, certain individuals used such patent for reporting to many authorities and threatened to lay charge against Seih-Ying. We were forced to use the Chinese Patent acquired in 1992 (higher patent level) to revoke the new patent applied by Shanghai Soda in 2004 (lower patent level) with record of public announcement. Nonetheless, 3W still refused to admit the patent revocation and lied under public eyes on their web site by claiming “the patent revocation was not true”, where they started the never-ending promotion with low-class text.

3. Certain individual used the name of Seih-Ying Co., Ltd. in Taiwan and submitted the glass road studs of inferior quality to the Inspection Center of Transportation Work under Department of Transportation for testing the compressive strength. The false report was soon published by 3W on their web site:

In China, Seih-Ying only makes submission to the Traffic Engineering Supervision & Testing Center under Ministry of Traffic Transportation. The false report suddenly appeared on 3W’s web site and aimed to attach Seih-Ying (Taiwan). In the concentrated anonymous attacks in August, relevant content was also mentioned. The slandering from 3W has violated the law in China apparently.

4. Unbelievable work of 3W’s false accusation provided by net friends:

If offended, shouldn’t Mr. Qie-Yi Chen from 3W and Ms. Yu-Mei Qiang from Shanghai Soda stand and defend for the reputation of their companies? The furious accusation that intends to divert the focus only reveals their low standard and truth of the matter.

Concerning a France company that declares Seih-Ying has stopped producing Siglite tempered glass road reflector. Seih-Ying makes a statement as follows:

1. The France company declares publicly that Seih-Ying has out of production, and all the products don’t apply to the standards of EU. However, all of the above doesn’t agree with the real situation.

2. The colored products of the France company were processed by spraying paints on the bottom. For the coloring technology, in fact, was copied from the outdated patent of Seih-Ying. Nevertheless, the bottom of color starts fading away after installing on the road for 6 months.

3. At present, the France company had moved their production line of glass road markers to China but they still declared that their products were made in France. Their relative certificates of CE and EN are applied for their France production line and ought to invalid since the movement.

4. Presently, Seih-Ying is developing the overseas market actively, in addition, the relative certificates and reports of CE and ISO were provided by the famous international certification groups. For this reason, Seih-Ying is still the leading company of glass road markers.

The 2nd generation of glass bulged road markers (stainless body) produced by 3W has a bulge height of 30 mm above ground surface and this does not comply with regulation of Section 5.1 “Requirements on dimensions” under JT/T390-1999 (“The height of bulge road marker shall be less than 25 mm” and “The height of general road marker under international code shall be less than 19 mm on highways and 25 mm on normal roads”). The relevant requirements of JT/T390-1999 are quoted as follows:
5.1 Requirements on dimensions
5.1.1 The bulged road markers are normally provided in rectangular, circular or elliptic shapes. All corners of the base that might experience vehicle running shall be round and the height of edge shall be less than 4mm.
5.1.2 For bulged road markers used for lane separators, the length (diameter) l1 of the side facing travelling direction shall be greater than 1mm, less than 150mm and the width of lane separator; the length (diameter) l2 of the side parallel with travelling direction shall be less than 150mm and l1. The height of bulged road markers shall be less than 25mm.
5.1.3 For bulged road markers used for lane edges, the length (diameter) l1 of the side facing travelling direction shall be greater than 100mm, less than 200mm and the width of lane edge; the length (diameter) l2 of the side parallel with travelling direction shall be less than 200mm and l1. The height of bulged road markers shall be less than 25mm.
5.1.4 For bulged road markers used for other marking lines, the width (diameter) shall be less than the width of marking line; the length (diameter) shall be less than the width and the height of bulged road markers shall be less than 25mm.

It is recommend to modify the height to be less than 25 mm, so the product can be used on highways.

In connection with patents related to tempered glass road marking reflectors and solar tempered glass road marking reflectors, the Seih-Ying Co., Ltd. from Taiwan has obtained several patents from many countries (including China). The colored glass road marking reflectors and dual-color glass road marking reflectors provided by Holophane from France are produced by painting the bottom of clear glasses, which early patents obtained by Seih-Ying (Chinese patent no. ZL93207894X, USA patent no. 5397617 and Japanese patent no. 2555905). Holophane did not make any product when Seih-Ying obtained above patents. Therefore, it is obvious that Holophane plagiarized Seih-Ying’s products and interference from irrelevant parties is not required. Seih-Ying will start to assign attorneys for thorough investigation on list of companies that plagiarize Seih-Ying’s various patents.

All patent rights under 3W Asia Ltd. (Shanghai) are invalid

We have received the “Decision for application of declaring Patent no. 11150 invalid” (issued on 2008.03.18) by the Patent Re-examination Board of the State Intellectual Property Office (SIPO) of the P.R. China. In connection with the patent (no. 200430024651.1) of appearance design applied by 3W Asia Ltd. (Shanghai) under the name of “Glass road marking reflector” in 2004, since it is obviously a plagiary of our new patent, the announcement of “all patent rights under 3W Asia Ltd. (Shanghai) are invalid” was drawn. All our relevant tempered glass road marking reflectors and solar tempered glass road marking reflectors are applied with patents in China and other countries. Please respect the intellectual property right to avoid unnecessary legal violation of infringement.

In connection with the test report coded "Jiao-Jian-Jian-Zi (W) [2007] no. 023", which is issued by Inspection Center of Transportation Work under Department of Transportation in Beijing on 18th December 2007, Seih-Ying neither submitted any document, nor authorized any company or person to submit such document. After investigation, it was discovered that certain party made the submission in our name with non-tempered false samples and this had constituted the offense of forgery under Criminal Law. Mr. Chen, the owner of 3W Asia Ltd. in Shanghai obtained this illegal test report immediately and published on the web site for actions of attack and calumniation. In addition to involvement of such calumniation, the part of forgery will be judged by the People’s Court. The Inspection Center of Transportation Work in Beijing has now reserved every evidence for testimony in Court.

Thank to the Abuse and False Accusation from 3W Asia Limited in Shanghai (China)

1. Over recent period, a company called “3W Asia Limited” has continuously abused and vilified Seih-Ying’s product on its website. We at Seih-Ying are surprised about existence of such company in China that has five thousand years of culture; however, the content in such website is not even worth a laugh. Out of our expectation though, some customers that never dealt with us actually linked to our website out of curiosity, after receiving the abusive information from this trading company (i.e. 3W Asia Limited) in Shanghai. After understanding the facts and further testing on our sample of “360°temperred glass road marking reflector”, these customers are convinced that quality of Seih-Ying’s products is far better than the imitation from China. They have started mass purchased after minor installation and test, and they are very satisfied with out products. To address these massive purchase orders that increased suddenly, we had to produce round the clock for fulfilling needs from these new customers. Therefore, we still need to thank the abuse and “advertisement” from 3W Asia Limited in Shanghai. Nevertheless, the old customers that have traded with us for many years do not pay attention to these abuses at all, but they only understand the true value of this company from Shanghai.
2. Mr. Chen, the owner of Seih-Ying is now the director of China Road Federation (CRF). Since the CRF has been established for 42 years, it is an important window of cross-strait contact for relevant unit of road and transportation. Mr. Chen has entertained many high-level leaders that are still in position for official and industrial fields in Chinese transportation. They have inspected Seih-Ying’s product – “360°temperred glass road marking reflector (glass road stud)” on highways and important public roads in Taiwan, and such marking reflectors with 5-10 years of lifetime massively used in Taiwan have given them strong and deep impression. In addition to raise a lawsuit to the Court in China for abuse from this trading company (i.e. 3W Asia Limited), Seih-Ying would also like to ask relevant official leaders in China to understand and keep a eye on the truth and this company.
3. We have received reply from relevant unit of certification in EU, which points out that VOV Certification Company in UK is not an unit approved by EU. Therefore, the CE, EN1463-1 and EN1463-2 that approved this trading company in Shanghai provide no public credit at all. If the customers use these illegal products and they cause problems, these customers will have to bear the legal and compensational liabilities in European countries at their own cost.
4. Once again, we would like to invite 3W Asia Limited to be our agent, because the glass road studs produced by Tai-An-Ying X Company under your agency are all common glasses and not tempered. If these products are used on public roads, there will be problem of legal charge for causing public hazard. For an enterprise to make monetary profit, such enterprise shall carry the social obligation on its shoulders at the same time.

Recent mailings from China
In the past month companies working in the same field received several mails with false and malicious statements and contents. The intension of these mails was to destroy the good reputation and image that Seih-Ying accumulates for long time. Seih-Ying condemns such act of inferiority and would like to offer few evidences for you:
1. All mails came from a free account of “Yahoo! China” instead of Belgium or Africa that are claimed in the content of each mail. Furthermore, the name of mail account is not in any form similar to general company (e.g.: haliluya, hellokitty123456, traffic1234 etc.).
2. The result of our search shows that host servers for the sender are all located in Beijing, China. Please refer to the attached file.
3. Certain English used in the mails are not used in English-speaking countries and they are actually slang used in China (e.g. “eat human meat without spitting bones”).
4. The mails of calumniation appeared on the Internet in massive amount within short time and this was not rational.
5. The content in the mails stated that delivery from Seih-Ying is “promised” to reach “Belgium, Africa etc.” within 2 weeks, which is impossible (the ship from Taiwan takes 1 month to reach Belgium and 1.5 months to reach Africa).
The obvious defects shown above can be easily spotted by you with extra caution.

Conclusion and outlook
Seih-Ying has always contributed its efforts in the industry with principles of “Human life requires utmost care” and “Life is priceless” because the industry of transportation safety relates to personal safety of all road users. Compressive strength of glass road markers	Fully tempered glass (automatic production) with compressive strength of approximately 40 tons, which is 95 tons for stainless steel tempered glass road markers (the abovementioned products fall under Seihying’s patents, as long as XW publishes its case no., Seihying will raise the patent cancellation at any time)	Non-tempered glass (manual) with compressive strength within 4 tons (which is only 1/10 strength of Seihying’s product and hence induces the greatest difference between Seihying and XW). Durability	The thickness of metal reflection coating is 50~100 times greater than vacuum coating and has achieved many engineering records with 15 years of durability.	The cost of traditional vacuum coating is low but it has been proved in Europe that color of such product starts to fade after half a year(products that only last half a year can only cheat people once even if they are very cheap).
Market share in Taiwan	Greater than 80%	Claimed by XW itself as 85% (According to investigation, the XW products cannot even pass strict standards in Taiwan and the application of such product has never been seen on Taiwanese roads. The record is obviously false).

The simple comparisons shown above are provided for convenience of all companies in the same trade to verify and test. We would also like to ask responsible person or technical personnel of Yingbiao (英鏢) Company in Sandong to come forward and clarify accordingly. If careless statements from a trading company with only few personnel keep publishing, 3W will only leads itself to worse position.

An Open Letter as Response to XW-Shanghai (XW Asia Limited)

1. Regarding relevant patent of 360°glass road marker, Seih-Ying has obtained such patents from many countries as early as in 1993, yet XW claims itself as the owner for designing patents (alleged that application made in 2004), which is clearly an imitation to our patent and under cancellation by Chinese Law. The fact is undebatable.
2. Regarding the so-called “Stainless steel glass road stud” recently published by XW, it also claims that the patent is under application. However, Seih-Ying has obtained the patent for such product from many countries long ago, which includes China:
USA patent: 5365372 (1994.11.15)
UK patent: 9317255.9 (1994.9.28)
Japanese patent: Shi-Kai-Ping 6-85413 (1994.12.6)
Therefore, the new product from XW at the end is another imitation to old product from Seih-Ying. Moreover, the imitation was made poorly; since the product contains solid structure, we have treated the product with tampering, where its strength can reach more than 95 tons. XW on the other hand claims that their product can reach strength more than 20 tons, thus there is great difference in the technical standard.
3. XW claims that “Tempering is simply a lie…, even students of primary school in China know that…” If this is so, after compressing Seih-Ying’s glass marker to 50 tons and cracks, why does it show particle finer than flat glass with horizontal tempering treatment? After compressing XW’s product to 4 tons and cracks, why does it show large pieces of glass trunks? Judging from the difference, XW simply makes false statement and intends to confuse the solid fact with it. The literacy of such false statement may reach well standard, yet the technical standard of products from XW might be far less than the standard of “students of primary school in China” claimed by itself.
4. XW also announced words such as “only vacuum coating with spray painting outside accounts product of true durability” and considered Seih-Ying’s products “to be dipped in hydrochloric acid…" which induces choking effects.
Regarding the sprayed protective layer that XW is so proud of, it is once again another imitation to Seih-Ying’s patent:
Chinese patent no. ZL93.2.07894.× - Corrosion-resistant road marker (1993.4.2)
To comment on words from XW, which road in the whole world is immersed in hydrochloric acid? If the whole road in front of XW contains hydrochloric acid, simply apply the corrosion-resistant protective layer according to Seih-Ying’s patent. Nevertheless, the current thickness of reflective coating from Seih-Ying is 50~100 times of the vacuum coating, which is already capable for more than 15 years of utilization on normal roads and requires no protective layer of spray painting.
A French company called “HOLOPHANE” copied Seih-Ying’s patent and added protective paint outside the vacuum plating (but the standard of imitation was poor). Since colored glass was used for the marker, the color faded after half a year! Such technology has been obsolete and the French company has stopped its production in Europe.
XW has once adopted pictures and information from HOLOPHANE, we are not certain if it has embezzled other pictures illegally or imitated immature products of HOLOPHANE.
5. On the web site of “Tai-an English mark signpost manufactory of Sandong”, Mr. Chen, the responsible person for XW Asia Limited, has left messages as a distributor; therefore, it is an undebatable fact that XW Asia Limited is merely a trading company. Since relevant Leader in Shanghai has visited the office of XW Asia Limited (which occupies area of approximately 50 square meters with only one staff), we like to point out that it’s already a shame to treat on foreigners, how can XW also treats on its own people in China?
6. Recently, there is a Chinese company announcing to the public that it has passed certification of ISO, CE and EN1463; however, such company only carries out trading activity and has no factory of its own at all. Possible method adopted might be taking a Taiwanese product under such company to obtain certification, and then pack products of inferior quality upon final delivery, so that clients can be deceived.
7. The Seih-Ying factory located in Hsinchu, Taiwan has been personally visited by many leaders of transportation industry worldwide and received well credits. As for a trading company in China, which markets with deception and gain higher popularity by attacking others with dishonesty, sympathy to such company is not worthy. As the leading company of 360°tempered glass road marker worldwide, Seih-Ying would like to make few suggestions:
(1) Do confirm the sample and quality before purchasing such product (self-test); see if the compressive strength reaches 40 tons, no problem shows under impact (1 kg steel ball dropping from height of 1.5 m), and there is sufficient thickness of metal reflection layer at bottom.
(2) Request certificate from the supplier together with patent that guarantees no imitation from others.
(3) Prior to delivery, it is preferable to execute personal inspection on products at the factory. Execute tests according to abovementioned qualities and note if the samples and products delivered are of the same brand and quality.
8. News update: The Taiwan Highway Administration has carried out official evaluation on Seih-Ying’s 360° glass road markers (SIGLITE) over highways in Taiwan:
- The average rate of breakage over 4 years (48 months) after installation by Northern District Project Office (NDPO) (Northern Taiwan) is only 1.5﹪
- The average rate of breakage over 4 years (48 months) after installation by Central District Project Office (CDPO) (Central Taiwan) is only 1.0﹪
From the above records, it can be seen that quality of SIGLITE has matched the name of “Most durable road reflective marker worldwide”. (Comparison for reference: On the same road section, all plastic square markers have to be replaced once every three months!)

An open letter to leaders of transportation safety equipment industries in China

Since the establishment at Taiwan in year 1990, we have been working with research and production of optical and special glasses. The 360°tempered glass road reflector is one of our products and due to its excellent quality, it is highly praised worldwide.
In 1993, such reflector obtained the new patent for practical products (Name of product: Corrosion resistant road reflector) by the Chinese Patent Office (currently renamed as “State Intellectual Property Office of P.R. China”) with Patent no.: ZL93207894X and the applicant, Ju-Mei Chen is the shareholder for Seih-Ying co., Ltd.
The same case has also received the USA patent under the patent no.: 5397617 with date of application: 1993.5.21 and date of patent: 1995.5.14.
The same case has also received the Japanese patent under the patent no.: 2555905 with date of application: 1993.5.21 and date of announcement: 1994.12.6.
In addition to its excellent quality over the years, the product has received the ISO9001 certification, as well as the EN1463-1 and EN1463-2 by EU that values people’s life and properties the most. In China, the product has passed various tests of JT/T 390-1999 under Ministry of Communications; the current records in tests of steel ball impact (no damage under impact from 1 kg of steel ball dropping from height of 1.5 m), compressive strength (40 tons) and durability have not been broken worldwide. According to official survey in 2007, the average rate of breakage from 4 years of application on Zhongshan Highway in Taiwan only incurred to 1.5%.
Recently, a company named “3W Asia Limited” in Shanghai has used “3W” as its brand and openly alleged on its web site that: “…created first glass road reflector in the world….and occupied 85% of market share in Taiwan…”. Moreover, it also indicates that “…certain small company from Taiwan has forged 3W patent under the name of capital company in Shenzhen…. its product only reach 1/8 of reflection under state standard…compressive strength is only 4 tons, which generates enormous hazards to passing vehicles.”
We at Seih-Ying consider that such open description of 3W on its web site has involved with forgery and since its patent has copied from our product, it has no legal effect whatsoever.
In view of this, Seih-Ying hereby makes the following open statement:
1. The patent applied by “3W Traffic Facility Limited (Shanghai)” (same as “3W Asia Limited”) for glass road reflector is the lowest level of patent for new models (only registered and not physically assessed) and the date of application is 15th June 2004. According to design drawing for their application, their product is a true imitation to patent for new models with higher level and applied under the name of Ju-Mei Chen in Seih-Ying Co., Ltd. Moreover, such product has been set with standard of CNS13762 at Taiwan in 1996, hence it no longer provides the condition of patent for new models.
In accordance with regulation under State Intellectual Property Office of P.R. China, we have prepared to cancel the patent that suffers improper imitation by “3W Traffic Facility Limited (Shanghai)”, so it will be exempted from being used as tool to attack other companies.
2. We did not impose any investment in Shenzhen; therefore, it is possible that 3W refers to another glass company and we have no comment on quality of that specific company. However, there is mistake in the statement of “…product only reach 1/8 of reflection under state standard” since the state standard has not yet been set in China at present and JT/T1999 is the occupation standard. There are words of exaggeration from 3W for claiming that it has set up the unified standard internationally.
3. In Taiwan, this product has be set with strict standard of CNS13762 as early as 1996; all glass road reflectors installed on highways and important roads must be tested on site via random sampling, where disqualified products would be removed immediately. According to actual test carried out by ARTC in Taiwan, product from 3W could not pass the test of CNS13762 and the strength was far less than our product, thus it could not be used on Taiwanese roads at all. Moreover, our product has been used at large quantities in Taiwan for the last decade with the trademark of “Lightening”; if 3W cannot display any proof document of custom to show its export to Taiwan, its statement of “…occupied 85% of market share in Taiwan” is involved with forgery.
4. The installation of this product relates to safety of people’s lives and properties significantly and since the patent for new model applied by Seih-Ying more than a decade ago has expired, we welcome all companies in the same industry to compete with us in terms of quality, cost, fairness and openness, so safety to road users worldwide can be protected.
